Hearing on the constitutionality of sedition, the Supreme Court in its landmark judgment has banned its use till the provisions of the sedition law are reconsidered. For the first time in 152 years, the provisions of the sedition law have been suspended. A three-judge bench of Supreme Court Chief Justice NV Ramana, Justice Surya Kant and Justice Hima Kohli, hearing the constitutionality of the sedition law, has given this verdict. The next hearing of the matter will be held in the third week of July.

Why did the Supreme Court ban the use of sedition law?


The Supreme Court on Wednesday banned its use, allowing the Center to reconsider the provisions of section 124A of the IPC, ie sedition. The Supreme Court has said that till the time the government is reconsidering the sedition laws, no new case will be registered under section 124A, nor will there be any investigation under it.


The top court has said that the provisions of the sedition law will remain suspended till further orders. The court has asked the Center that it can make such guidelines for the states, so that till the review of this law, the rights of people arrested under section 124A can be protected.


Earlier, while hearing the case, the court had expressed concern about the use of the sedition law. The Central Government had sought permission from the Supreme Court to reconsider the provisions of the Sedition Act, ie Section 124A of the IPC.



What will happen to those who have already registered sedition cases or are in jail?


In its order, the Supreme Court has asked to maintain status quo on pending sedition cases. What will happen to those who are already booked for sedition or are already in jail under it? Dainik Bhaskar asked this question to Supreme Court lawyer Virag Gupta, he said, "The cases which are already registered under sedition or those who are already in jail - such people can file their bail petition under the purview of the law." Huh.''


Virag said, "At the same time, the court has asked the Center to issue necessary guidelines regarding new cases under sedition, so that till the hearing is going on, new cases under sedition are not registered."


What is sedition law, when was it made, how much punishment?


According to the definition of sedition in section 124A of the Indian Penal Code, i.e. IPC, if any person insults or tries to degrade the national symbols or the constitution or writes or speaks anti-government material, then treason under IPC section 124A. case may be registered. Apart from this, any speech or expression which seeks to incite hatred, excitement or discontent against the government in the country also comes under sedition. At the same time, if a person has any kind of cooperation with anti-national organizations, knowingly or unknowingly, then he also comes under the purview of sedition.
