Supreme Court Chief Justice NV Ramana retired on Friday. In the last two days of his tenure, he heard many important cases. Giving farewell to the Ceremonial Bench, Attorney General KK Venugopal said, "With your retirement we are losing an intellectual and an outstanding judge. At the same time, Senior Advocate Dushyant Dave started crying in the court room itself. He said- You are the judge of the people.
This was the first time in the history of the Supreme Court that a CJI's ceremonial bench was live-streamed. Which was webcast on the website of the Supreme Court.
Hearing of these cases in the last two days
Karnataka Coal Mining- Increase in iron ore mining limit for mining firms in Bellary, Chitradurga and Tumakuru districts of Karnataka.
Free election announcements- Referred freebies matter to a 3-judge bench.
Gorakhpur riots case- Petition challenging the sanction to prosecute Chief Minister Yogi Adityanath in the 2007 hate speech case dismissed.
Insolvency Law- The Insolvency and Bankruptcy Code (IBC) will apply to the Customs Act. Customs authority can only determine the quantum of duty and levy but cannot initiate recovery proceedings.
Pegasus- Committee found malware in 5 phones, but it was not clear whether it was Pegasus. The committee said that the government did not help. The next hearing will be held in the last week of September.
Bilkis Bano- Notice has been given to the Gujarat government, has asked 11 guilty to form a party. The next hearing will be held two weeks later in September.
Notice has been given to the Central Government on PMLA- Review Petition. Also said that this law is very important, and only 2 aspects are worth reconsidering. One provision of not giving the report of ECIR (FIR registered by ED) to the accused and the other provision to be on the accused to prove his innocence.
PM Modi Security Breach - The committee formed to investigate PM Modi's security breach case told the Supreme Court that the SSP in Ferozepur failed to perform the duty to maintain law and order.
Was angry with the process of registry, also said in farewell speech
NV Ramana has been distributing the master of roster case for hearing in 16 benches of the court. But in the past, he was helpless in front of the Supreme Court registry regarding the listing of cases. In fact, a case listed for hearing on August 17 was removed by the Registry. CJI Ramana was very angry. He had said that he would speak on the issue in his farewell speech on August 26.
However, during his farewell speech, he said that the issue of pendency is the biggest challenge and I agree that listing is one area where I could not pay much attention. I'm sorry for that. The only way to improve the system is to deploy modern technologies and artificial intelligence. But unlike commercial organisations, we cannot buy them from the market.
Ramana had also said that there are many issues on which he wanted to raise questions, but he did not want to speak before leaving the post.
Live streaming was to be done from 2018, but the court did not use it
Earlier on 26 September 2018, a 3-judge bench of the Supreme Court had allowed live-streaming of hearings except in cases involving sexual offenses and matrimonial disputes. However, the Supreme Court did not adopt it in practice. Many High Courts of the country like Karnataka, Gujarat, Odisha are broadcasting the hearing live on their respective official YouTube.
UU Lalit to be next CJI
After the retirement of CJI Ramana, Justice UU Lalit will be the 49th CJI of the country. Justice Lalit will take oath as CJI on August 27. Justice Lalit, the second senior-most judge of the Supreme Court, will become the CJI for just 74 days, as he will retire on November 8. Justice Lalit has been a part of several landmark judgments including outlawing the practice of 'triple talaq'.
